1. Acceptance of Terms

By downloading, accessing, or using the Brainy Engage app (the "App"), you ("User") agree to be bound by these Terms and Conditions ("Terms"). The term "User" applies to all account types: Class Instructors who create and list classes, and Students or Parents/Guardians who browse and book classes.

If you do not agree to these Terms, do not use the App.

2. Eligibility

• You must be at least 18 years of age to create and maintain an account on the App.
• By using the App, you represent and warrant that you meet this age requirement.
• Brainy Engage reserves the right to verify eligibility and suspend or terminate accounts that do not comply.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at hello@brainyengage.com if you suspect unauthorised access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Class Instructors

• Instructors may list classes, set schedules, and communicate with enrolled students through the App.
• Instructors are solely responsible for the accuracy, quality, and legality of the content and classes they provide.
• Instructors must not misrepresent their qualifications, credentials, or class content.
• Instructors agree not to contact students or parents/guardians outside the App for commercial purposes related to the classes.
• Brainy Engage reserves the right to remove any class listing that violates these Terms or our community standards.

5. Students and Parents/Guardians

• Students and Parents/Guardians may browse, book, and attend classes listed on the App.
• Bookings are subject to availability and instructor approval where applicable.
• Cancellation and refund terms will be set out separately per class listing. In the absence of specific terms, no refunds are guaranteed during early access.
• Parents/Guardians are responsible for ensuring their child's appropriate use of the App.

6. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Post or transmit content that is harmful, offensive, defamatory, or inappropriate.
• Attempt to gain unauthorised access to any part of the App or its systems.
• Use automated tools, bots, or scrapers to access or extract data from the App.
• Impersonate any person or entity.
• Harass, intimidate, or harm other users.
• Use the App to collect personal data of other users without their consent.

7. Intellectual Property

All content, trademarks, logos, and software within the App are the property of Brainy Engage or its licensors. You may not reproduce, distribute, modify, or create derivative works without express written permission.

By submitting content (such as class descriptions or profile information) to the App, you grant Brainy Engage a non-exclusive, royalty-free licence to use, display, and distribute that content within the App.

8. Limitation of Liability

Brainy Engage does not endorse or verify the qualifications of any instructor listed on the platform. Users engage with instructors at their own discretion.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

10. Changes to These Terms

We may update these Terms from time to time. We will notify all users of material changes at least 14 days in advance via the App or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Georgia, unless otherwise required by applicable consumer protection laws.

• Account information: Name, email address, account type (Instructor / Student / Parent), and password (encrypted).
• Profile information: Profile photo, bio, and instructor qualifications where provided.
• Usage data: Pages visited, features used, session duration, and interaction patterns within the App.

• Communications: Messages sent between users through the in-app messaging system.
• Booking data: Class bookings, cancellations, and attendance records.

14. How We Use Your Data

We use your data to:

• Create and manage your account.
• Facilitate class bookings and scheduling.
• Enable communication between instructors and students/parents.
• Improve and personalise your experience in the App.
• Send important service notifications (e.g. booking confirmations, policy updates).
• Ensure the safety and security of the platform.
• Comply with legal obligations.

We do not use your personal data for targeted advertising.

15. Data Sharing

We do not sell your personal data. We may share data only in the following circumstances:

• With other users: Instructors' public profiles and class listings are visible to students and parents. Student names are visible to their enrolled instructors.
• Service providers: We may share data with trusted third-party providers (e.g. cloud hosting, analytics) who process data on our behalf under strict confidentiality agreements.
• Legal requirements: We may disclose data if required by law, court order, or to protect the rights and safety of our users.
